TERMS OF SERVICE
I, the participant of a now or tone. session, voluntarily choose to engage in physical activities, including but not limited to CRUSH workouts (lift & run) with treadmill, dumbbell, kettlebells and hip bands as well as reformer workouts, at now Studios or tone. Studios. I acknowledge that these activities involve inherent risks and the potential for injury. By signing this waiver, I agree to release and discharge the Studio, its instructors, employees, and affiliates from any and all claims, demands, causes of action, or liability for any injury, loss, damage, or death arising from my participation in these activities.
I understand and acknowledge the following:
Assumption of Risk: I am aware that participating in physical activities carries inherent risks, including the risk of serious injury or death. I voluntarily assume these risks and agree to participate in these activities with full knowledge and understanding of the potential dangers.
Medical Considerations: I hereby certify that I am physically able to participate in these activities. I am solely responsible for my own health and well-being, and I have consulted a medical professional if I have any pre-existing medical conditions, injuries, or concerns that might affect my ability to safely engage in these activities.
Release and Indemnification: In consideration for being allowed to participate in these activities, I hereby release, waive, discharge, and covenant not to sue the Studio, its instructors, employees, and affiliates for any claims, demands, actions, or liabilities related to injuries, damages, or losses that I may incur during my participation.
Photography and Likeness Release: I grant the Studio the right to use any photographs, videos, or recordings of me taken during my participation for promotional purposes, including but not limited to social media and marketing materials.
Jurisdiction and Severability: This waiver shall be governed by the laws of Switzerland. If any provision of this waiver is deemed unenforceable, the remaining provisions shall remain in full force and effect.
Personal belongings: I am aware that personal belongings in the studio closed lockers or outside cannot be protected by the studio, the risk of lose or robbery is acknowledged. By signing this waiver, I agree to release and discharge the Studio, its instructors, employees, and affiliates from any and all claims, demands, causes of action, or liability for any loss or robbery.
